Dr.Nowhera Shaik clearly states how ED has been clearly violating and ignoring the Supreme court’s orders.  Petition highlights the ED’s actions and omissions in relation to the case. Dr.Nowhera Shaik, who has been involved to these injustices, deserves a fair and impartial review of her case. The ED is accused of not obeying with the Telangana High Court’s and Supreme Court’s orders of transfer of investigation to the SFIO and also for its own controversial steps. Still ED continued its investigation, conducted raids, and seized assets despite court orders.

The ED’s continuous  failure to follow with court orders and its actions that contradict judicial orders results in  a clear case of contempt. The petition seeks to address these violations by the court and ensure adherence to the legal rulings made by the Telangana High Court and the Supreme Court.

ED’s Non-Compliance

Even after court’s clear orders, the ED failed to transfer the investigation to the SFIO as ordered by court. Instead, it continued its investigation and filed an application before the Adjudicating Authority under the Prevention of Money Laundering Act (PMLA), without disclosing the December 23, 2019, judgment.

Hon. Supreme Court’s Concerns and Property Dispute

The Supreme Court’s order on March 28, 2023, marked concerns regarding land disputes involving Dr.Nowhera Shaik. The court told that the buyers were aware of the ongoing disputes but were willing to proceed with their investments. The court says that if these buyers deposited around Rs. 641 crores, it would lift the ED’s attachment on the land, leaving the parties to resolve their legal claims independently.

 Again, the ED allegedly obstructed this process, resulting in encroachments on the property meant to be used for repaying investors. The petitioner argues that these encroachments, occurring under the ED’s watch, represent a serious violation of legal standards and have further complicated the resolution of the case.

When the Struggle of Dr Nowhera Shaik Will End ?

When will Dr Nowhera Shaik’s struggle end? Her ongoing battle against the (ED) has caused her hardship. Despite court orders of transfer of her case to the Serious Fraud Investigation Office (SFIO), the ED has continued its actions, including issuing eviction notices, conducting raids, and seizing assets. These actions not only violates court orders but also complicate the case.

Dr Nowhera Shaik deserves a fair and impartial incestigation of her situation. The continuous non-compliance with court orders and the resulting legal complications have only made her suffer.

Is ED Setting a Good Example ?

By violating the Supreme courts order is Enforcement Directorate setting a good example. ED was made for investigating financial crimes and for enforcing law by staying under the rule of law. But crossing the line by disobeying court’s order is itself a very worse example. The actions of ED overlook judicial rulings. For a government body like the ED, setting a positive example involves following strictly to legal and judicial rules, ensuring transparency, and maintaining fairness. But in the case of Dr.Nowhera Shaik ED is clearly failing to do so.
